haha, Jim reads every single word I write on this message board (not exaggerating), so I’m sure he’ll find this thread and get all bent out of shape about it. He keeps telling everybody that he wants to be left alone, yet he keeps making blog and bulletin posts on myspace about how me and the band are a bunch of assholes and should not be supported. He has lost his mind, any last shred of respect we had for him, and his wishes for anyone in BoE to keep quiet about him.

I'm not up on my internet law. Calling Aaron wouldn't do anything, she should have gotten an attorney to at least write a C&D if she had a real claim.

Whether someone called her ugly or not has no relevance. If she APPROVED of the pic being there BEFORE the comments, then she would have no case, that is true. If she did not approve of the pic being there, she has possible grounds for defamation or another charge, ESPECIALLY if it was an amateur nude photo to which the IP belonged to the plaintiff.

I wasn't here, so I don't know the story.

But let's say someone put a nude or compromising picture up of you on a website, Carina, WITHOUT your permission, and you were unhappy about it. Then you asked to take it down, and they didn't. You really think you'd have no legal recourse?

posting links is not illegal and if devin had just posted a link to her naked picture (hosted on another site), then I would have told them and their lawyer to piss-off. but legally, if you post the image inline then you are distributing it (even if it's not on your sever) as a secondary provider. unfortunately, in that case, they were legally correct.

fastforward 2-3 years and someone links me to their site which has one of my pictures on it and it's actually hosted on their site.

and MSD is correct, jim reads this board (don't think I can't figure out your ip there mister) and the chances are 99% that he has already read this thread.
